Job Description

Manage the litigation of ABMZ;
Assess Court documentation and advise the Bank the best way for settlement of the litigation case;
Initiate Court proceedings by Bank or against third parties on behalf of the Bank in agreement with Head of Legal;
Draft Court documentation required for each court proceeding, applications, contestations, appeals, requests and others and submit to Court;
Pay Court fees on time and avoid any fine in the process where Bank is the Demandant or demanded part;
Keep updated the records or list of litigation by or against to the Bank;
In alignment with Litigation Officer, Roll out the Litigation risk assessment in annual basis (Litigation CPA);
Support all business areas and functions in relation to their Litigation Risk and provide legal opinion or service required to achieve their business and functional objectives;
Manage relationships with external lawyers using best supplier management practices and get monthly litigation report for the litigation assigned to external lawyers;
Manage Court orders and inheritance processes and instruct Business Units on how to proceed or reply to Court or other competent Authority;
Prepare and submit in quarterly basis the litigation report to the Litigation Trial Ready Forum;
Attend the Disciplinary Committee and Fraud Forum;
In alignment with Litigation Officer, submit the quarterly Litigation Report of cases equal or above threshold according with Legal Risk Group Policy and respective provision to Group Litigation Team, ABMZ ERC, Operational Risk and Finance;
Raise and Control of provision in monthly basis against respective cases and report any (i) release of provision or (ii) application of provision for loss;
Draft and delivery Loan payment agreements with defaulting client (NPL);
Support Human Capital with disciplinary and Court proceedings when required;
Prepare the witnesses and representatives of the Bank before trial or judgement in court;
Roll out the Litigation training to Business Units within the Bank;
Assist colleagues in Branches with potential or litigation matters;
Produce and keep updated a list of all litigation by or against to the Bank;
Make presentation of the litigation report to the Litigation Trial Ready Forum;
Assist and help CIB Legal Counsel to deliver to the Business Unit in other matters than litigation, if required.
